1.1 Term of Service: The service agreement begins once the User successfully subscribes to a hosting plan or any other service offered by Savana Host. This agreement remains in effect for the duration of the User’s subscription, either on a monthly, annual, or custom plan, as outlined during sign-up. Upon subscribing, you are granted access to our hosting services, subject to these Terms.
1.2 Payment Obligations: By subscribing to our services, you agree to pay all applicable fees as outlined for the selected plan. Payments are due upon subscribing and must be processed before the services can be activated. The payment methods available include credit cards, bank transfers, PayPal, and other methods supported by Savana Host. All payments are non-refundable unless otherwise stated under Section 2 of these Terms.
1.3 Account Renewal and Automatic Billing: All hosting plans, unless otherwise specified, automatically renew at the end of each subscription cycle (e.g., monthly, annually). You authorize Savana Host to automatically charge your payment method for renewal fees. Users will receive a reminder notification before renewal. If payment is unsuccessful (e.g., expired credit card), Savana Host may suspend or terminate access to services until the outstanding balance is cleared.
1.4 Accurate Billing Information: You agree to provide accurate, current, and complete billing information when registering for our Services. If your billing information changes (e.g., new credit card, updated billing address), you are responsible for updating it in your account settings. Failure to provide accurate billing details may result in the suspension or termination of your account.
1.5 Free Trial Periods: If you are using a free trial period for any of our services, the trial period is subject to the specific conditions provided at the time of registration. After the free trial ends, your subscription will automatically convert to a paid subscription unless you cancel the service before the trial period ends.
2.1 Refund Eligibility: All fees paid for services are generally non-refundable. This includes, but is not limited to, payments for domain registration, web hosting, and any other supplementary services. However, under certain circumstances, we may offer a refund as follows:
2.2 Refund for Hosting Service: If you are dissatisfied with your hosting service within the first 30 days, Savana Host may provide a refund of the hosting fees, excluding any setup fees or additional services such as domain registration. Refund requests must be submitted to our customer support team within the first 30 days of your subscription. After 30 days, no refunds will be issued.
2.3 Refund for Domain Registration: Domain registration fees are generally non-refundable, as domain names are registered with third-party registrars. However, in the event of a clerical error or service failure on our part, we may issue a refund for domain-related charges, subject to the domain registrar’s policies.
2.4 Process for Refund Requests: Refund requests must be made via the support portal, and all requests will be reviewed by the Savana Host support team. Refunds will be processed to the original payment method and may take up to 10 business days.
3.1 Domain Registration: Savana Host provides domain registration services through our partnered registrars. When registering a domain through Savana Host, you agree to follow the rules and regulations set by the domain registry. You are solely responsible for maintaining the accuracy of your domain registration details, including contact information and payment details.
3.2 Domain Ownership: Once you register a domain through Savana Host, the domain is yours for the duration of the registration period, subject to timely payment and renewal. You retain full ownership and control over the domain unless otherwise stated. However, Savana Host reserves the right to suspend or terminate domain registration services in cases of fraud, illegal activities, or breach of these Terms.
3.3 Domain Renewals: Domain names must be renewed before their expiration date. Savana Host will notify you in advance of your domain’s expiration and provide instructions for renewing it. Failure to renew your domain on time may result in loss of the domain, and Savana Host is not responsible for any loss or inconvenience caused by failure to renew.
4.1 Acceptable Use Policy: You agree to use the Savana Host services only for lawful purposes. You may not use our services to host, display, or distribute illegal, harmful, or infringing content. Prohibited activities include, but are not limited to:
4.2 Resource Usage: Savana Host provides resources based on the hosting plan selected. If your account exceeds the allocated resources (e.g., bandwidth, disk space, CPU), we may ask you to upgrade your plan or limit your use to avoid affecting other users.
4.3 Service Suspension or Termination: Savana Host reserves the right to suspend or terminate services for accounts that violate these Terms, including excessive resource usage, failure to pay, or engaging in prohibited activities. Any suspension or termination will be preceded by a warning notice when applicable.
5.1 Access to Support: Savana Host provides customer support via email, live chat, and phone (during business hours). Support inquiries are addressed based on priority, and we aim to respond within 24 hours. Emergency issues or technical support for critical service failures may be expedited.
5.2 User Responsibilities: When submitting support requests, you must provide clear and complete information regarding the issue. This includes relevant login details, error messages, and any actions taken leading up to the issue. Failure to provide sufficient information may delay resolution.
6.1 Ownership of Content: You retain full ownership of any content you upload to our servers, including text, images, videos, code, and other media. By using Savana Host services, you grant us a non-exclusive, worldwide license to host and display your content as necessary to provide our services to you.
6.2 Savana Host Intellectual Property: All proprietary software, code, trademarks, logos, and other intellectual property provided by Savana Host remain the property of Savana Host or its licensors. You are granted a limited, non-transferable license to use Savana Host’s services under the terms set out in this agreement. You may not copy, modify, or redistribute any of Savana Host’s intellectual property without prior written consent.
7.1 Limitation of Damages: Savana Host’s liability for any claim arising from the use of our services is limited to the total amount paid by you for the services in question during the 12-month period immediately preceding the event leading to the claim. We will not be liable for any indirect, incidental, or consequential damages, including lost profits or data.
7.2 Force Majeure: Savana Host is not liable for failure to perform its obligations under these Terms if such failure is due to causes beyond its control, including but not limited to natural disasters, internet outages, acts of terrorism, or government regulations.
8.1 Governing Law: These Terms are governed by the laws of the jurisdiction in which Savana Host operates. Any disputes arising from or related to the use of our services shall be resolved under the laws of that jurisdiction, excluding any conflict of law principles.
8.2 Dispute Resolution: In the event of a dispute, both parties agree to attempt to resolve the issue through informal discussions. If a resolution cannot be reached, the dispute will be settled through arbitration or mediation. Arbitration will be conducted under the rules of a mutually agreed arbitration body, and the decision will be binding.
